Welcome to PostTender. These Terms and Conditions ("Terms") govern your use of the PostTender mobile application and website (collectively, the "Platform") operated by Yadav Enterprises ("Company", "we", "us", or "our").
By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Platform.
2.1. To use certain features of the Platform, you must register for an account.
2.2. You must provide accurate, current, and complete information during registration.
2.3. You are responsible for safeguarding your account credentials and for all activities under your account.
2.4. You must be at least 18 years old to create an account.
2.5. One person or business may not maintain multiple accounts.
3.1. Posting Tenders: Consumers may post tender requests specifying their requirements, location visibility radius (e.g., 15km, 30km, 50km, or custom), and validity period.
3.2. Tender Visibility: Tenders are visible to Service Providers within the specified geographic radius who operate in the relevant service categories.
3.3. Receiving Bids: Consumers will receive bids from interested Providers through in-app messaging. Consumers are free to accept, negotiate, or reject any bid.
3.4. Communication: Consumers may communicate with Providers through the in-app messaging system. Verified Providers may contact Consumers via WhatsApp for faster communication.
3.5. No Guarantee: We do not guarantee that you will receive bids or find a suitable Provider for your tender.
4.1. Viewing Jobs: Providers can view Tenders posted within their service area and in their registered categories.
4.2. Placing Bids: Providers may submit bids with quotes, messages, and optional images explaining their offer.
4.3. WhatsApp Contact: Only Verified Providers may use the WhatsApp contact feature to directly contact Consumers.
4.4. Service Quality: Providers are solely responsible for the quality, legality, and safety of services they offer.
4.5. Accurate Information: Providers must ensure all business information, including name, location, categories, and contact details, is accurate and up-to-date.
5.1. Purpose: The Verification Program helps establish trust by verifying Provider identity and business legitimacy.
5.2. Requirements: To get verified, Providers must:

5.4. Subscription: Verification is valid for one year from the approval date. Providers must renew annually to maintain verified status.
5.5. Revocation: We reserve the right to revoke verification status for violations of these Terms or fraudulent activity.
6.1. Consumer Usage: Posting tenders and receiving bids is free for Consumers.
6.2. Provider Usage: Basic Provider accounts are free. Premium features like verification require a paid subscription.
6.3. Payment Processing: Payments are processed through secure third-party payment gateways (e.g., Razorpay). We do not store credit card information.
6.4. Refunds: Verification fees are non-refundable once the verification request has been processed and approved.
6.5. Subscription Cancellation: Providers may cancel their subscription at any time. Verified status remains active until the end of the billing period.
7.1. Marketplace Only: PostTender is a marketplace platform connecting Consumers with Service Providers and Sellers. We are not a party to any agreement between users.
7.2. No Employment Relationship: Service Providers and Sellers are independent contractors, not employees of PostTender or the Consumer.
7.3. No Warranty: We do not guarantee the quality, safety, or legality of services or products provided by Service Providers and Sellers.
7.4. Dispute Resolution: Disputes between Consumers and Providers should be resolved directly between the parties. We may assist in mediation but are not obligated to do so.
Users must not:
9.1. User Content: You retain ownership of content you post. By posting, you grant us a non-exclusive, worldwide license to use, display, and distribute such content on the Platform.
9.2. Platform Content: All Platform content, including logos, designs, and software, is owned by Yadav Enterprises and protected by intellectual property laws.
9.3. Content Removal: We reserve the right to remove any content that violates these Terms without prior notice.
10.1. To the maximum extent permitted by law, PostTender and Yadav Enterprises shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
10.2. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.
10.3. We are not liable for losses resulting from actions or services of third parties, including Service Providers and Sellers.
You agree to indemnify and hold harmless Yadav Enterprises, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
12.1. You may delete your account at any time through the Platform settings.
12.2. We may suspend or terminate accounts that violate these Terms without prior notice.
12.3. Upon termination, your right to use the Platform ceases immediately.
We reserve the right to modify these Terms at any time. Significant changes will be communicated via email or Platform notification. Continued use after changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws applicable in your country of residence. Any disputes shall be resolved through arbitration or the competent courts of the jurisdiction where you reside.
